He was sentenced to death by lethal injection when he was found guilty of committing a quadruple murder in which partners of his former company were involved. The events took place in the town of Bartow Polk County and Florida. Throughout the proceedings, the multiple shortcomings in substantiating the case are evident, such as the failure of Ecuadorian and U.S. authorities to comply with the national and international norms regarding the manner of his extradition, as well as the minimal effort by his lawyers to prove his innocence. The analytical methodology used in this research exposes in a clear and detailed manner the procedural deficiencies that were not applied to ensure the correct exercise of a minimum guarantee of due process. The case of Nelson Iván Serrano has a significant public impact. It is marked by numerous legal and procedural inconsistencies, which have resulted in violations of individuals’ inherent rights. To date, the case raises uncertainty about his guilt, casting doubt on whether all the events and actions of the judicial authorities, both Ecuadorian and American, have been correct.
