Universidad Católica de Cuenca.13BT-D2024-AB-52https://dspace.ucacue.edu.ec/handle/ucacue/17482El proyecto de investigación tuvo como finalidad analizar las particularidades que se han presentado en los reglamentos artesanales de la legislación ecuatoriana que conllevarían a otorgar ventajas al maestro de taller respecto a otros empleadores en general, esto conforme con lo regulado por el artículo 302 del Código del Trabajo en concordancia con lo establecido en el artículo 16 de la Ley de Defensa del Artesano y artículo 25 de la Ley de Fomento Artesanal, a través de un enfoque cualitativo, para profundizar y entender las concepciones, leyes y opiniones artesanales, aplicando los métodos; descriptivo, sistémico- estructural-funcional y analítico- sintético. El resultado principal fue que la Ley no ampara a quienes no hayan sido acreditados por la Junta Nacional de Defensa del Artesano y la Ley de Defensa del Artesano, por lo tanto, justifica un trato de desigualdad.Abstract The purpose of the research project was to analyze the particularities that have been presented in the artisan regulations of the Ecuadorian legislation that would lead to grant advantages to the workshop master with respect to other employers in general, this according to what is regulated by article 302 of the Labor Code in accordance with what is established in article 16 of the Law of Defense of the Artisan and article 25 of the Law of Artisan Promotion, through a qualitative approach, to deepen and understand the conceptions, laws and artisan opinions, applying the methods; descriptive, systemic-structural-functional and analytical-synthetic methods.
