El objetivo de esta investigación es, precisar los perjuicios causados a la ciudadanía, por no aplicar de forma correcta la Ordenanza que, regula y legaliza en los tiempos establecidos en la misma, los bienes que no tienen titular de dominio. La investigación tuvo un enfoque mixto con énfasis, en lo cualitativo, se emplearon métodos como el inductivo-deductivo, lógico, analítico, sintético e histórico. En nuestro caso de estudio, se determinó como consecuencia de ello la evidente Vulneración a la Tutela Judicial Efectiva, por parte del Gobierno Autónomo Descentralizado del Cantón Quito, en la regularización de bienes que no tienen titular de dominio. En solución a esto propone que, su procedimiento sea más efectivo y con expedita celeridad procesal.The vulnerability to effective judicial protection is the procedure for awarding urban properties under the modality of non-disposable property, it is one of the serious problems faced by the Decentralized Autonomous Govermment of Quito. The objetive of this research is clarify the prejudices caused by not determining that there is an specific ordinance that regulate and legalizes in the establish times the properties that do not have a property owner. The investigation had a mixed approach with a focus on qualitative research, method such as inductive, deductive, logical, analytical, synthetic and historical were used. Consequently in this research the Infringement of the Right to Judicial Protection was evidenced by the Decentralized Autonomous Govermment of the Quito in order to regularize the properties that do not have a domain owner.
