Universidad Católica de Cuenca].13BT-D2020-AB-17https://dspace.ucacue.edu.ec/handle/ucacue/11959La presente investigación tiene como objetivo analizar y plantear las diferencias entre Signos Distintivos y Nombres Comerciales, para establecer dichas diferencias hay que entender a la Propiedad Intelectual, conocer su historia en breves rasgos, conocer los diversos tratados y convenios que regulan la Propiedad Intelectual; de este modo para establecer dichas diferencias, hay que estudiar las funciones y requisitos necesarios para la obtención del registro tanto de Signos Distintivos como de Nombres Comerciales partiendo de una definición clara de dichos conceptos, su naturaleza jurídica y características; de la misma manera se hablará de la Competencia Desleal, como se encuentra normada y definida, que se consideran Actos de Competencia Desleal y que tipo de acciones se deberían tomar frente a estos, todo esto conforme la normativa vigente en nuestro ordenamiento jurídico, lo mismo que se desarrollara en el presente trabajo investigativo.The objective of this research is to analyze and propose the differences between Distinctive Signs and Company Names, to establish these differences, it is necessary to understand the Intellectual Property; to know its history in brief, know the various treaties, and conventions that regulate the Intellectual Property; this way, to establish the aforementioned differences is necessary to study the functions and the requirements needed to obtain the registration of both Distinctive Signs and Company Names based on a clear definition of the concepts, their legal nature, and characteristics.
