The principle of innocence, a fundamental human right, requires adequate protection, which every justice system must guarantee; its disrespect or violation entails the transgression of other fundamental rights. Therefore, the principle of presumption of innocence must comply with all the structure and processes established in the Fundamental Charter and International Instruments. This research will determine how the control of conventionality is applied as a guarantee of the legal status of innocence and the mechanisms used by the administration of justice to safeguard legal certainty and ensure the human right of innocence. It will be achieved by studying the judgments issued by the Inter-American Court of Human Rights and the resolutions inherent to the principle of innocence of the Constitutional Court to establish whether or not there is a violation of this principle as a procedural guarantee, rule of treatment, measure, and judgment.
