The Ecuadorian prison system faces difficulties in providing adequate medical care to these people. Lack of resources, limited infrastructure, and a lack of trained medical personnel are obstacles to the health care of inmates with dire illnesses. The fundamental importance of guaranteeing this right will be addressed. The legal, ethical and social applications that derive from its adequate protection will be analyzed. In addition, we will raise the challenges against the violation of the right to health from the sentence mentioned in principle. The methodology of this research is developed under a cross-explanatory criterion, seeking as such an answer to the different problems in the field of Constitutional and Criminal Law, specifically in the inconsistencies of compliance with a constitutional sentence where a person deprived of liberty with illness catastrophic needs a specialized health center for control, examinations, food and medicines strictly, the existing vulnerability of the rights in the rehabilitation centers of Ecuador, the same that will be identified through the collection of information. The analysis of compliance with Sentence No. 209-15-JH/19 by the state regarding access to the specialized health system for persons deprived of liberty with catastrophic illnesses from the CRS Turi social rehabilitation center, the problem is that if there is compliance on the part of the state in guaranteeing the right to health to the inmates who are inside the prison with a catastrophic illness in the city of Cuenca, however there is non-compliance on the part of the State in guaranteeing the right to health of the ppls with catastrophic diseases, lately by local media it was also possible to observe conflicts due to the situation of not having a CRS Turi polyclinic in operation for timely and necessary care. And where the authorities did not know how to justify. As a result, it was observed that there are violations of fundamental rights of great magnitude, since there are ppls not only with one disease but with several, there is a case that we met where a person was diagnosed with foot cancer before entering the Turi prison. , and over time he presented problems with diabetes and cardiac hypertension, which he did not know about the medical controls by the authorities, nor his treatment, which is not in compliance with the sentence mentioned in the previous paragraph.
