- ÍtemAcceso AbiertoEl reconocimiento de los derechos de las familias homoparentales en la legislación ecuatoriana frente al principio de interés superior del niño, niña o adolescente.(Universidad Católica de Cuenca., 2022) Guananga Loja, Daysi Belen; Ochoa Avila, María Fernanda; Culcay Villavicencio, Ivan Patricio; 0105344113.; 0106499189Homoparental Families have been maintaining a constant struggle to be accepted by traditional society so that their rights are recognized, some of these rights continue to be violated, such as the right to adoption that in our legislation is not allowed for couples of the same sex, it is important to understand that minors who are in the country's orphanages have been victims of violation of their rights, such as the right to develop within a traditional family or of a different type as recognized by the Constitution of Ecuador, it is emphasize that same-sex marriage has been recognized by our legislation and it is for this reason that this community has acquired rights, one of them being adoption, where the rights of homoparental families are not violated, as well as the rights of the minors. Therefore, the present work is based on a doctrinal investigation and comparative legislation where it is shown that the rights of homoparental families are not contrary to the principle of the best interests of minors, rather, they are closely related to each other. In addition, we present the case of Luis, a child who was raised by a homosexual uncle and his partner, where it is evident that said sexual orientation never caused any type of impairment in his integral development, on the contrary, the minor grew up in a healthy and he developed with good values within this type of family.
