Ítem Acceso Abierto Análisis de los efectos jurídicos del aborto punible, a una mujer violada y su criminalización por parte del estado(Universidad Católica de Cuenca., 2019) Malave Saldarriaga, María Antonieta; González Gutiérrez, Milton Alejandro; 1309466348"In Ecuador, abortion is allowed under two causalities in accordance with article 150 of the Comprehensive Criminal Organic Code, the first reason is: if it has been practiced to avoid a danger to the life or health of the pregnant woman and: if the pregnancy is the result of rape in a woman who suffers from mental disability, for these two cases it is non-punishable abortion, which means that abortion is decriminalized for these two cases. This investigation is an analysis of the legal effects of punishable abortion, a raped woman and her criminalization by the State; and their involvement in the victims as a result of criminalization by the act of aborting, through Comparative Law, the presentation of cases and statistical data. Then, it is the criminalization of raped women who, as a result, suffer a forced pregnancy and decide to have an abortion. which leads them to face a judicial process against them. Therefore, a reform of the law is required for these cases. "
