Ítem Acceso Abierto Las repercusiones del síndrome de estocolmo en el procesamiento de los delitos de violación y abuso sexual en la provincia del cañar(Universidad Católica de Cuenca., 2022) Astudillo Japa, Karina Isabel; Hidalgo Flores, César Felipe; 0105587612; Ordoñez Carpio, Fernando EstébanThe victim of sexual crimes became more relevant since the implementation of the Comprehensive Organic Penal Code (COIP, by its Spanish acronym), analyzing the causes of victimization through the approach of psychological and social aspects in greater depth. Thus, one of the main affectations suffered by victims of sexual abuse or rape is the Stockholm syndrome: a behavioral deviation that makes the victim feel affection for the aggressor without informing his situation and even covering the violence received. Thus, at the national level, legal research on this syndrome is scarce and addresses only areas of psychology. Consequently, this study analyzes five files of sexual abuse and rape in the province of Cañar within the period 2019 -2021. Through an approach in the three means of evidence, to determine indications of the presence of the referred syndrome. The results indicate that in all cases, more than half of the signs are inclined to the existence of Stockholm syndrome, concluding that although this affectation could exist, the criminal prosecution excludes this problem.
